1. Acceptance of Terms

By creating an account or using FitScout (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

FitScout is an AI-powered fitness platform that generates personalized workout plans, tracks training progress, and provides adaptive program recommendations. The Service is provided on a subscription basis with both free and paid tiers.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you represent and warrant that you meet this requirement.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@fitscout.me if you suspect unauthorized access.

5. Subscriptions and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Cancellation takes effect at the end of the current billing period.

6. Health & Fitness Disclaimer

FitScout is not a medical service and does not provide medical advice. Workout plans are generated by artificial intelligence and are for informational and general fitness purposes only. Consult a qualified healthcare professional before starting any new exercise program, particularly if you have any medical conditions or injuries. You assume all risk associated with your use of any workout plans generated by the Service.

7. AI-Generated Content

Workout plans and recommendations are produced by AI models and may not always be accurate, appropriate, or suitable for your specific situation. FitScout does not guarantee the accuracy or completeness of AI-generated content. Always use your own judgment before performing any exercise.

8. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms.
Attempt to reverse-engineer, scrape, or extract data from the Service.
Share your account credentials with others.
Interfere with or disrupt the integrity or performance of the Service.

9. Intellectual Property

All content, features, and functionality of the Service — including software, text, graphics, and AI models — are owned by FitScout and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time via your account settings or by contacting us.

11. Limitation of Liability

To the maximum extent permitted by law, FitScout shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes take effect constitutes acceptance.
